Looking Out for Owners' Best Interests

It's good to know that as a timeshare owner you are not alone. There are industry organizations that have owners' best interests at heart. Groups like the Florida Timeshare Owners Group (FTOG), The National Timeshare Owners Association (NTOA), American Resort Development Association’s special owner’s group ARDA-ROC and Timeshare Board Members Association (TBMA), make disseminating information to owners their priority. They work to keep owners aware of industry-related news and activities nationwide, changes in the industry and legal issues that may impact owners, as well as information on industry research and ongoing studies to improve the industry.

State Groups

Most states have their own timeshare owner group. These groups are particularly important because each state has different laws affecting timeshare that may change from time to time and owners need to be aware of any changes. Their meetings often include legal updates and other valuable industry information. 

As an example, the Florida Timeshare Owners Group's upcoming November meeting features the head legal counsel of a Florida law firm whose specialty is representing owners who experience disputes or differences with their timeshare resort, the management company or the resort developer.  The FTOG meeting also has scheduled guest speakers representing various exchange companies who will update owners on the latest benefit options. Plus, Greg Crist, CEO of NTOA, will give an update on timeshare industry-related activities nationwide and the evolving future of timeshare.

National Timeshare Owners Association (NTOA)

Another organization that owners can count on for valuable information is NTOA. Through partnerships with technology experts, they gather information and conduct studies of issues affecting the industry. A recent study resulted in data that provided insights on the latest consumer attitudes toward timeshare.  

Another groundbreaking study is in the works. NTOA's Secondary Market Solutions committee is working with the University of Central Florida to analyze and prepare data for the association’s first executive study on timeshare resale issues. These studies are made accessible to owners and others in the industry. 

Timeshare Board Members Association (TBMA) 

TBMA is a non-profit association dedicated to helping provide technical, organizational and moral support to directors of owner controlled timeshare boards. The group offers educational panels and meetings such as one recently held in Denver, which focused on the future of legacy resorts and how to help them compete successfully in a competitive timeshare market. The TBMA website offers a wide variety of information delivered through downloads, podcasts, reports on industry trends and more.  

American Resort Development Association (ARDA)


In case you need reminding, the industry's trade association ARDA offers a wealth of information on its website, from the latest in regulatory and legislative issues to questions about buying and selling and how to avoid scams. ARDA represents and advocates for the industry on regulatory issues, provides educational and networking opportunities at annual conventions, and ARDA-ROC reaches out to members with the latest industry news, market intelligence, trends and events. When was the last time you visited the ARDA site? 

Maneuvering the Timeshare Secondary Market

You're probably used to seeing a lot of advertising from "postcard companies" soliciting anyone looking to get rid of their timeshare. As timeshare popularity continues to grow, these solicitations stand out, because most owners are happy with their timeshare and are not thinking about selling. But, if this is a time in your life when you have a reason to sell, there are resources to help you maneuver your way through the timeshare secondary market, avoid the scams, and even find alternatives to selling.

Where to Start

The approved party line on the retail market is ARDA-ROC's Timeshare Resale Resource Center. Since its inception in the 70's, ARDA has offered information on the often confusing and frustrating secondary market. They have held symposiums, monitored resale companies and utilized industry leaders to come up with the best solutions. The Timeshare Resale Resource Center site can answer most if not all of your questions. 

First Steps

The very first step the site recommends is to consult your resort developer, manager or owners' association. Often homeowner associations or the management company have websites or newsletters for advertising your timeshare. They may also have a resale program or an affiliated licensed broker that handles resales. Find out how much past resales sold for, what was the commission, and answers to other concerns. And don’t forget the other owners at your resort. If they own weeks before or after you, or own only a small amount of points, they may wish to purchase more time.

Answers to all Concerns

With the Timeshare Resale Resource Center, ARDA-ROC is attempting to answer the concerns and provide information about all aspects of maneuvering the secondary market from buying to selling. Questions about what kinds of resale companies are around, how to prepare to sell and price your timeshare, how to know if a company offering to sell your timeshare is legitimate, and much more can be answered on this site. 

Alternatives to Resale

Don't forget that there are alternatives to selling - in fact selling is not always the best option to choose.  Consider donating your weeks to charity or philanthropic causes. Organizations like Send Me on Vacation, can make you feel good by making someone else feel good through a donation of a vacation to a breast cancer survivor. Give your family or friends the gift of a week or points, rent your timeshare, trade for a cruise, or check with your resort developer or manager about giving your timeshare back.

Continuing Research 

The National Timeshare Owners Association (NTOA) is working on their first executive study on timeshare resale issues. They are partnering with Dr. Tammie Kaufman, a timeshare professor at the University of Central Florida, industry professionals and timeshare owners to analyze and prepare data compiled by the associations Secondary Market Solutions committee.  NTOA wants to help meet the need to educate consumers on how to buy or sell timeshares safely in the secondary market because of the problem of unscrupulous telemarketing and resale operations. According to NTOA more than 10 billion in available inventory sits idle with more piling on each year due to these scammers.

Continuing Education for Owners

Are timeshare owners aware of the numerous ways to get the most out of vacation ownership? Do they know and understand all the current issues affecting ownership? Dial-An-Exchange (DAE), a worldwide vacation exchange provider, thinks it may be time for more education - particularly since timeshare has experienced so many changes over the past decade. DAE recently re-launched an owner education program first used in 2008, called Vacation Education Series (VES).

What's it All About?

The Vacation Education Series (VES) hits the road with its program in San Diego on March 22. DAE is making it convenient for owners to attend VES by holding it where the owners live and not where their timeshare is located - San Diego has a large percentage of owners who live within a 20 mile radius. Sessions are designed to educate timeshare owners and potential buyers about the many ways they can get the most out of timeshare. Current timeshare issues affecting ownership will also be on the agenda and open for discussion. The informal and non-threatening roundtable discussions led by industry leaders, are meant to encourage owners to ask questions, participate and interact with each other.

"The Vacation Education Series was created and designed to offer timeshare owners vast resources that encompass all aspects of ownership," explained Susan Friedline, DAE Business Development Manager USA. "It is a forum to educate as well as update them on the current issues that can affect their ownership. We are excited to have the opportunity to talk to owners and learn more about their needs to continue to partner with reliable resources to fulfill those needs."

Topics for next week's San Diego series include the Future of Timeshare, Resales and Rentals, Know What You Own, Explore Exchange, and Advantages of Proactive Ownership.

Other Industry Educators

Other timeshare entities are also looking out for the best interests of owners with their educational offerings.

RCI
As part of its Affiliate Access Program, RCI offers a series of HOA-focused "Lunch and Learn" events where owners can talk with RCI representatives about best practices to get the most out of vacation ownership. These 3/4 day, no-cost information sessions are held in a relaxed setting enabling participants to talk face-to-face with representatives, ask questions, share ideas and enjoy lunch together.

American Resort Development Association (ARDA)
ARDA represents and promotes vacation ownership in various capacities. Its web site provides a wealth of information for owners ranging from updated legislative issues that may affect timeshare owners and their well-being (ARDA-ROC), to assistance and resources for HOA members (HOA Outreach).  On the ARDA site, owners and potential owners can find the answers to all their questions concerning ownership, and the latest news and research on timeshare issues, exchange tips, resale guidelines and much more.

The National Timeshare Owner Association (NTOA)
NTOA dedicates its business as a platform to advocate for timeshare owners, and to educate and help owners find answers to their timeshare questions and concerns.  Aligning itself with industry and community partners, NTOA offers a multi-media internet education center. In addition to their Feedback Page, its toll-free consumer helpline (1-844-ASK-NTOA) offers owner assistance with timeshare related issues.

Owner Forums
Timeshare forums can be a good place for owners to talk to other owners, share experiences and get questions answered. Many timeshare and vacation companies such as Wyndham, TripAdvisor and RedWeek all have their own owner forums.

5 Ways to Help You be a Better Timeshare Consumer

You’re a timeshare owner or thinking about becoming one, and you’ve got some concerns. You’ve heard stories about unscrupulous timeshare companies, resale scammers, promises unkept, ridiculously high maintenance fees, and the list goes on. So how can you protect yourself and enjoy the many positive aspects of timesharing? There are groups available to help you protect your investment - American Resort Development Association, Federal Trade Commission, Better Business Bureau, State Department of Justice Consumer Protection—but the number one person to start with is you.

1. Be Your Own Advocate
  • Before and after you purchase a timeshare you must be your own advocate. New buyers need to do their homework. It is never wise to jump into any purchase that requires a sizeable investment before you do the research. Find out all the information you need to calculate the cost of a timeshare. Add up such costs as mortgage payments and all expenses like annual maintenance fees (does the plan have a fee cap?) and taxes, broker fees, finance charges, closing fees and even travel costs. Compare these costs to the cost of renting similar accommodations in the same location for the same length of time and in the same time period. Include amenities too. If the timeshare still looks good after the comparison, then go on to the next step.
  • Check with the local consumer protection agency in the company’s home state to see if there are any complaints against the company. Check out the property, quality of the resort and availability of units. Talk to current owners about their experiences—does the owner keep up the maintenance of the property? Make sure you understand all the paperwork involved, find out about cancellation policy and other issues of concern. Set up an escrow account for undeveloped properties and a written commitment from the seller as to when the facilities will be finished. That way, you protect yourself should the developer default.
  • Once you take the plunge and become an owner you need to continue to advocate for yourself by keeping informed of the latest timeshare legislation, getting actively involved in timeshare advocacy groups, and if you really want your voice heard, become a member of your timeshare’s Board of Directors.

2. American Resort Development Association (ARDA)
Timeshare owners have a fair and unbiased resource as well as a legal advocate with ARDA.  As ARDA’s website states, "our Government Affairs Team has a strong record of successfully advocating for the policies contributing to the growth and vitality of the industry while protecting the vacation ownership experience." ARDA’s website is full of information on the latest news and legislation effecting timeshare. Its 10 advisories, listed on the ARDA website help guide owners through the secondary market that includes timeshare resellers, internet advertisers and resale companies. The ARDA Resort Owners Coalition (ARDA-ROC) helps to protect owners by working to prevent legislation that might have a negative impact on timeshare. Funded by timeshare owners’ contributions (often as little as $1 checked off of the maintenance fee form) owners can take part in protecting and enhancing the timeshare experience.

3. Federal Trade Commission (FTC)
The FTC is another entity actively involved in helping the industry. Their joint task force, combing federal, state and international law enforcement, has been successful in bringing actions against companies involved in timeshare scams. Their website is an excellent source of information on the ins and outs of buying a timeshare, and recent criminal prosecutions and legislation concerning the industry. 

4. Better Business Bureau (BBB)
Just as you would investigate any business that you’re thinking of working with, investigating the business you’re going to buy your timeshare from is a must. The BBB is a good place to review a business, find out its BBB rating and if there are any registered complaints against it that haven’t been resolved. The BBB also offers its own information about buying a timeshare. Contact your timeshare company’s local BBB for information.

5. State Department of Justice Consumer Protection
As state law varies from state to state, and country to country, you might want to check out the timeshare company through the State Department of Justice or Attorney General’s Office of Consumer Protection for local laws governing timeshare. For instance, if you purchase a timeshare and then decide to back out, in Florida you have 10 business days to return it for a full refund, in Nevada it’s 5 days, and in Indiana it’s only 3 days. These offices also have access to any pending legislation against companies. 


Timeshares Continue Strong Growth

New construction starts support the results of the American Resort Development Association’s (ARDA) research findings showing the timeshare industry to be one of the fastest growing. ARDA’s 2012 World Wide Shared Vacation Ownership Report showed North America topping the timeshare global list with the most properties—2500 resorts or 46 percent of the total market. Timeshare companies are actively involved in building and acquiring new additions to their properties.

Breckenridge Grand Vacations is breaking ground this summer on a new resort on its Peak 8 property. Reportedly being called the pinnacle resort within the community, the exclusive 75 residence resort boasts 28,000 sq. ft. of amenity space and 4500 sq. ft. of space for resort operations.

Welk Resorts Celebrates 50 years in the Business with Further Expansion

This year, Welk Resorts is celebrating its 50th anniversary. Supported by capital obtained by the completion of a $158.67 million securitization last December, Welk has plans for more development. In June, Welk completed their multimillion dollar renovation of the Welk Resort Branson. In December, the Northstar Lodge was officially opened as a Welk Resort. In the works for 2015 are 123 luxury units in Breckenridge, and by 2018, 164 units in Poipu, Kauai.

More New Construction Rumored

Silverleaf Resorts is building a new sales center and reportedly bringing in award-winning companies like Architectural Concepts to design a more contemporary look for their resorts. Rumor has it that Westgate Resorts is on the lookout for new sites to construct in Northern and Southern California.

Future Growth Predicted in New Global Markets

The World Wide Shared Vacation Ownership Report research indicated that timeshare’s future will include more growth in the global timeshare market (now nearing 2%). The research reports 5300 resorts in 108 countries supporting more than 1.1 million jobs and generating over $45 million in direct economic output in 2010. Findings also show that ownership is likely to expand to numerous countries, particularly Brazil, Russia, India and China.

Technology a Big Focus at ARDA World 2013

Over 3,000 delegates from 35 countries representing the shared ownership industry were at the Westin Diplomat Resort & Spa this past week in Hollywood, Florida,for one of the top events on the timeshare calendar – ARDA World 2013.

The event’s global sponsors include some of the biggest names in travel, including American Express, Diamond Resorts International, Hilton Grand Vacations, Holiday Inn Club Vacations, Starwood Vacation Ownership, Wyndham Vacation Ownership, RCI and Interval International.

The conference, was held from April 7-11, 2013, and more than ever the emphasis was on technology.

Key presentations include Don Tapscott’s talk on “The strategic value of IT Investment” with many other educational sessions on the subject that covered everything from Internet marketing to using software to provide better customer service.

SPI Software was one of the exhibitors, and VP of Customer Service Gordon McClendon participated on a panel session entitled “Pork Chops and Applesauce…Technology to Satisfy Customers.”

Breckenridge Grand Vacations has once again made a major impact in the Awards program of the American Resort Development Association (ARDA).

The success in the annual international competition for the best timeshare sales and marketing teams and individuals is a credit to the company, said David Stroeve, RRP, Vice President of Sales.

Over the past eight years, Dave and his team have won the prestigious ARDY in numerous categories. This year is no different. When the winners are announced this week at ARDA World 2013 in Hollywood, FL, Breckenridge Grand Vacations (BGV) will be again represented by a slate of stellar finalists.

In the category of Marketing Team, the BGV Event Team is a top ranked finalist. Last year the BBGV Marketing Services Team won the “ARDY” for best in the world.

Timeshare Company’s Founder to Retire from Marriott

Marriott Vacations Worldwide has announced that Robert A. Miller, executive vice president and chief operating officer for the company’s international region, will retire by the end of this year.

A 35-year industry veteran, Miller started his career in 1978 with the co-founding of American Resorts Corporation which was purchased by Marriott International, Inc. in 1984.

The new division launched Marriott as the first branded hospitality company to enter the timeshare industry by more than a decade.

“Bob leaves an impressive legacy. His leadership in the early formation of the industry helped structure important legislation and consumer regulations that created a platform on which the industry would grow,” said Stephen P. Weisz, president and chief executive officer for Marriott Vacations Worldwide.

Miller came on board with Marriott when it acquired American Resorts, where he was the president and chief operating officer. He served as president for the timeshare division until 1996 and grew the business from $5.4 million to nearly $258 million during that time and also led the Marriott Golf business.

Throughout his career, Miller has been an active member of the vacation ownership industry. He was a member of the board of directors for Interval International for more than five years.

Miller has also played a key role in the American Resort Development Association (ARDA) by serving as its treasurer in 1997, and then as chairman from 1998 – 2001. He is currently a member of the executive committee and the board of directors, as well as chairman of the ARDA International Foundation.

In 1991, Miller was named ARDA’s Resort Industry Executive of the Year, due to his enduring efforts to bring the segment to the forefront of the hospitality industry, and in 2005, received ARDA’s ACE Lifetime Achievement Award.

$70 Billion Added to U.S. Economy by Timeshare Industry

2011 Figures Impressive and Indicators Continue to Look Positive for Travel Industry 

The U.S timeshare industry contributed an estimated $70 billion in consumer and business spending to the national economy in 2011, according to a study conducted by Ernst & Young for the American Resort Development Association (ARDA).

“With the easing of capital markets and pent up demand for travel and family vacations, sales are beginning to increase once again, reported Howard Nusbaum, president and CEO of ARDA. "The $6.5 billion timeshare industry is making a major impact on local economies throughout the country.” 

“It’s encouraging to see these numbers – we aren’t just bringing people a better way to vacation, we are making a serious bottom-line economic impact, “Nusbaum said.

The impact of the timeshare industry on the U.S. economy extends beyond timeshare resorts, including the economic impacts of sales and marketing offices, corporate operations, the construction of new resorts, the renovation of existing resorts, and the significant impact of expenditures of vacationers during timeshare stays.

This study estimates the comprehensive private and public sector benefits generated by the timeshare industry. Combined direct, indirect, and fiscal impacts in 2011 by the U.S. timeshare industry included $70 billion in consumer and business spending, 493,000 full- and part-time jobs, $23 billion in salaries and wages, and $7.7 billion in tax revenue.

Overall, the travel industry has been creating jobs 26 percent faster than the rest of the economy since March 2011, creating 271,000 new jobs in that time. There are over 194,200 units in 1,548 timeshare resorts in the United States, encompassing a significant portion of the U.S. hospitality industry.


Spending by timeshare owners and guests during timeshare stays was estimated at $9.3 billion in 2011. About $1.5 billion was spent on-site at resorts, while $7.8 billion was spent off-site in the communities where the timeshare resorts are located. In addition to private sector benefits, the timeshare industry contributes significantly more federal, state, and local tax revenue per employee than the average industry, totaling $7.7 billion in 2011.

Welk Resorts Earns 2012 ACE Employer of the Year Award from ARDA

California-based Welk Resorts, an industry leader having over 40,000 owners in San Diego, Palm Springs, Cabo San Lucas, and Branson, MO, received the 2012 ACE Employer of the Year Award from the American Resort Development Association (ARDA).

6. The ACE Spirit of Hospitality Award went to Paulette Carter of Starwood Vacation Ownership, who began her career in housekeeping, and today she oversees operations at five resorts.  Her insistence on high standards has placed her resorts among the most requested by owners in her company’s network. This award recognizes an outstanding employee who has demonstrated commitment, loyalty, superior performance, and the willingness to go above and beyond.

7. The ACE Employer of the Year Award went to Welk Resorts, which has a long tradition of giving back to its employees, and treats its employees like family. This award recognizes an employer that has demonstrated exceptional commitment to its employees. 

8. The ACE Volunteer Award went to Ken McKelvey of Defender Resorts, Inc., who has been a leading advocate for the rights of timeshare owners everywhere throughout his career.  This award is given to a member of ARDA who consistently gives his/her time, energy, creativity, and talents to further ARDA’s goals and objectives. 

9. The Ingersoll and Bloch Industry Advocate Award went to Robin Suarez of Starwood Vacation Ownership, Inc., for her efforts in defending the business of timesharing and supporting the rights of timeshare owners.   This special award is designed to recognize individuals who have made extraordinary efforts on behalf of the timeshare industry in the legislative and regulatory arena.

ARDA Announces 2012 Circle of Excellence (ACE) and ARDY Winners

“It’s about recognizing the ‘best of the best’ in the vacation ownership industry,” said Howard Nusbaum, president and CEO of ARDA. “It’s an opportunity to take time and applaud the efforts of individuals who have been recognized by their peers for the impact and perseverance they have shown in their professional lives.”
1.The ACE Lifetime Achievement Award went to Frank Chapman, an international visionary since the 1960s. This award is given to an individual whose leadership, professionalism, creativity, reliability, and quality standards and ethics are demonstrated in an outstanding body of work. 

2.The ACE Project of Excellence went to Grand Lodge on Peak 7, Breckenridge, CO. This award is given to a successful project that represents months and years of cooperation between all parties involved and is considered a success not only by investors but by owners and the local community. 

3.The ACE Community Service Award went to Interval International for its help in bringing vacations to deployed and wounded soldiers and their families. This award recognizes outstanding community contributions by an ARDA member individual or organization.

4.The ACE Women on their Way Award went to Mandi Weigel of Grand Pacific Resorts, who worked her way from administrative assistant to resort area general manager.  Along the way she proved to be an innovative leader through goal-oriented employee programs, employee safety, and green company initiatives. This award recognizes the outstanding achievements of women who continue to excel and advance in the industry.

5.The ACE Philanthropic Award went to Christel House Open Tournament Host Companies, who help run a benefit golf tournament organized by a host committee of 14 different companies across the timeshare industry. Proceeds from the tournament go toward ending childhood poverty. This award recognizes the outstanding philanthropic effort for a humanitarian cause by an individual or company. 


ARDA Associate Member of C.A.R.E.

ARDA (American Resort Development Association) has joined C.A.R.E (Cooperative Association of Resort Exchangers) as an Associate member.

“It is a great honor to welcome ARDA as a new member of our organization,” said C.A.R.E. president Alain Carr. “C.A.R.E. appreciates the participation of Howard Nusbaum and Jason Gamel at our conferences this past year, and C.A.R.E. has benefited from the knowledge and insight in our industry that they were generous enough to share with us.

Timeshare Scams on the Rise Again

The website Business News Express posted an article on March 3, 2011, written by Kris Hana, titled "Illegal Timeshare Sales on the Rise." In that article, Hana quotes Florida timeshare victim advocate attorney Susan Budowski, who warns consumers to be aware that with the resurgence of the timeshare industry, timeshare scams will rise with it.

Hana notes that Howard Nusbaum, President of the American Resort Development Association, stated “The travel and timeshare industry is seeing a resurgence of travel in 2011, terrific news for the timeshare industry.” And that has led Attorney Budowski to explain that this also brings more victims of deceptive sales practices by unscrupulous sales representatives.

Reports Hana, Budowski adds, “Unfortunately many timeshare owners are getting taken advantage of multiple times. I have seen those who have been misled or coerced into buying a timeshare and then later desperate to get out of their contract, attempt to sell their timeshare only to be taken advantage of by a resale company.”

This is evidenced, says Hana, by a recent SWAT team raid of a purported timeshare resale company by the Orlando Police Department. A spokesman for the Orlando Police Department said, “The company was taking two to four thousand dollars per customer without providing any services. The raid and arrests were a result of timeshare owners from Florida to Canada filing multiple complaints.”

Attorney Budowski advises timeshare owners that feel they have been a victim of a resale scam to contact their local authorities. She adds, “The majority of legitimate real estate transactions do not require an upfront fee to try to sell or rent a property; if a company does, that should raise a huge red flag.”

Budowski also warns of a surge in timeshare cancellation companies on the Internet and utilizing similar unscrupulous telemarketing firms to take advantage of timeshare owners’ misfortunes, reports Hana. “These companies make false claims of legal expertise and claim to guarantee refunds and/or cancellations of timeshares, and like the resale companies, require an upfront fee, many times exceeding what it would cost to hire an attorney.”

Timeshare Owners Needs Addressed on New ARDA Website

The American Resort Development Association (ARDA) has launched a new website devoted to the needs of timeshare owners. The ARDA Resort Owners Coalition (ARDA-ROC) has been a big influence among 'homeowner associations', representing and lobbying for the needs of many committees across North America.

Its new site - ARDAROC.org - will cater to existing timeshare owners "who already own the product, and understand it, but look at some of the issues facing owners today," according to ARDA's CEO and president, Howard Nusbaum.

ARDAROC.org is geared up to inform and motivate timeshare owners to take action on issues that affect them. Among the key features at ARDAROC.org is an interactive map for owners to select their home state and learn about the latest news and issues that ARDA feels should be useful to them.

Stories making headlines include news of a major change proposed by a house bill in the state of Utah under the Timeshare and Camp Resort Act which could allow delinquent owners to avoid obligations to their homeowners association without penalty under certain conditions - a situation that ARDA will fervently lobby against to protect HOAs.

The latest addition to ARDA's web repository is funded by a cross section of the timeshare industry including major developers, management companies, and other industry service providers.

ARDAROC.org is ARDA's third website. The Association's home base, ARDA.org, caters to industry needs, while the consumer-facing VacationBetter.org is a flag waver for the affirming benefits of timeshare for prospective owners.
